Researchers increasingly rely on large data sets of health information, often linked with biological specimens. In recent years, the argument has been made that obtaining informed consent for conducting records-based research is unduly burdensome and results in ?consent bias.? As a type of selection bias, consent bias is said to exist when the group giving researchers access to their data differs from the group denying access. Therefore, to promote socially beneficial research, it is argued that consent should be unnecessary. After (...) analyzing the biostatistics evidence and bioethics arguments, the article concludes that (1) claims about the amount of consent bias are overstated; (2) commonly used statistical methods usually can account for consent bias; and (3) any residual effects of consent bias are below an acceptable level of imprecision and constitute a reasonable social cost for conducting ethically responsible research. Teachers may be skeptical about the possibility of implementing transition pedagogy, as outlined in the first part of this book, given the current context of higher education. Here we synthetize therefore the pedagogical tools that we have identified in the courses offered by establishments that have practiced a transition pedagogy for a long time, as well as those being used at the Campus de la Transition since 2018. We also draw on interviews with experts and practitioners, psychologists, teachers and explorers (...) of new practices. Mobile devices with health apps, direct-to-consumer genetic testing, crowd-sourced information, and other data sources have enabled research by new classes of researchers. Independent researchers, citizen scientists, patient-directed researchers, self-experimenters, and others are not covered by federal research regulations because they are not recipients of federal financial assistance or conducting research in anticipation of a submission to the FDA for approval of a new drug or medical device. This article addresses the difficult policy challenge of promoting the welfare and interests of (...) research participants, as well as the public, in the absence of regulatory requirements and without discouraging independent, innovative scientific inquiry. Individual differences in ethical ideology are believed to play a key role in ethical decision making. Forsyths (1980) Ethics Position Questionnaire (EPQ) is designed to measure ethical ideology along two dimensions, relativism and idealism. This study extends the work of Forsyth by examining the construct validity of the EPQ. Confirmatory factor analyses conducted with independent samples indicated three factors – idealism, relativism, and veracity – account for the relationships among EPQ items. In order to provide further evidence of the instruments (...) nomological and convergent validity, correlations among the EPQ subscales, dogmatism, empathy, and individual differences in the use of moral rationales were examined. The relationship between EPQ measures of idealism and moral judgments demonstrated modest predictive validity, but the appreciably weaker influence of relativism and the emergence of a veracity factor raise questions about the utility of the EPQ typology. Beginning in the 20th century, scientific research came to be dominated by a growing class of credentialed, professional scientists who overwhelmingly displaced the learned amateurs of an earlier time. By the end of the century, however, the exclusive realm of professional scientists conducting research was joined, to a degree, by “citizen scientists.” The term originally encompassed non-professionals assisting professional scientists by contributing observations and measurements to ongoing research enterprises. These collaborations were especially common in the environmental sciences, where citizen scientists (...) participated in counting wildlife and measuring environmental conditions. Later, patient groups began to play a more active role in supporting clinical trials and collecting health records from affected individuals. (shrink)

To understand the prospects for global order and progress in the coming years, we explore the joint implications of three premises: (1) states advantaged by the current international order have stakes in its regularity and predictability, and thus in moving to counter or prevent threats to those stakes; (2) along impure public and club goods lines, they are more likely to make efforts to do so when some private or club benefits result; and (3) public opinion provides a bounded policy (...) acceptance envelope offering incentives and disincentives to national political elites to act as envisioned by the first two premises. We present a mosaic of public opinion in major OECD countries (the US, Japan, and major EU members) on three policy areas that contain international public goods elements. Actual contribution tendencies in those areas found in our previous work largely conform to the public opinion patterns reported here. Within the limits of available data, domestic political incentives as represented by public opinion warrant neither extreme optimism nor pessimism about the prospects for continuing contributions by OECD states to sustaining orderly functioning of the current world system. Purpose: To determine the relative value that patients place on consent for procedures in the emergency department (ED) and to define a set of procedures that fall in the realm of implied consent. Methods: A questionnaire was administered to a convenience sample 134 of 174 patients who were seen in the ED of a Midwestern teaching hospital. The questionnaire asked how much time they believed was necessary to give consent for various procedures. Procedures ranged from simple (venipuncture) to complex (procedural (...) sedation). Results: Participants valued a simple blood draw at a low mean of 1.02 minutes of extra time and a lumbar puncture at a high mean of 7.78 minutes. Of all participants 52% and 48% noted a time-value of ?0? time on blood draw and intravenous line starts, respectively, indicating that they desire no additional consent for these procedures. Conclusion: Defining a set of ED procedures covered under implied consent will be difficult because many patients value formal consent for even the simplest procedure. (shrink)

Genomic research results and incidental findings with health implications for a research participant are of potential interest not only to the participant, but also to the participant's family. Yet investigators lack guidance on return of results to relatives, including after the participant's death. In this paper, a national working group offers consensus analysis and recommendations, including an ethical framework to guide investigators in managing this challenging issue, before and after the participant's death.

De façon plus urgente, c'est la question de la vérité qui doit être traitée dans la mouvance d'un triple héritage de conceptions : la conception de la vérité comme réalisme; la conception positiviste (...) en réaction au kantisme, et depuis le début des années 60, une conception qui doit redéfinir et repenser le réalisme. L'exploration historique et conceptuelle permet à la fois une critique des pratiques et des illusions de ces trois derniers siècles, et des questions nouvelles quant à l'avenir de la raison tant du côté des sciences que du côté du pouvoir. Car c'est de la commu­nauté humaine et de l'homme qu'il s'agit avant tout, ce qui interdit de faire définitivement l'impasse sur des problèmes qui sont avant tout la responsabilité d '« hommes finis », ce qui induit la nécessité de choisir une éthique et d'adopter une ontologie.For some years our societies, more and more marked by the services and restraints of the sciences and technology, find relations between politicians and scholars strained. As a result, the rather traditional ques­tion of the relationship between truth and authority has been put in new terms. In a more urgent way, it is the question of truth that should be treated in the sphere of a triple inheritance of ideas : the conception of truth as realism, the positivist conception in reaction to Kantianism, and, from the begiming of the 60's, a conception that would redefine and rethink realism. A historical and conceptual exploration allows both a critique of the practices and illusions of these last three centuries, and new questions as regards the future, both on the side of the sciences and on the side of power. For, above all, the concern is with the human community and man, and thus prohibits a definitive impasse concerning these problems, which are, above all, the responsibility of « finite men ». Shoshana Zuboff’s international bestseller, The Age of Surveillance Capitalism: The Fight for a Human Future at the New Frontier of Power, was reviewed in the Wall Street Journal as a book that asks us ‘to pause long enough to think about the future and how it might be different from today.’ That description could work as the definition of the literary utopia or dystopia. In fact, Zuboff’s book has consecutive chapters titled ‘Big Other and the Rise of Instrumentalist Power’ and (...) ‘A Utopia of Certainty’. In the former chapter, the title of which seems to reference George Orwell’s Nineteen Eighty-Four, Zuboff argues that there now exists a ‘ubiquitous digital apparatus’ that ‘renders, monitors, computes and modifies human behaviour’. In the latter chapter she asserts that the ‘surveillance capitalist leaders [such as Mark Zuckerberg and Larry Page, CEOs of Facebook and Google respectively] are sui generis utopianists’. This article critically assesses Zuboff’s claims in relation to Dave Eggers’ 2013 novel The Circle, where the eponymous utopian/dystopian company’s name, as well its motto ‘ALL THAT HAPPENS MUST BE KNOWN’ gesture towards Jeremy Bentham’s panopticon writings. This article explores Zuboff’s factual and Eggers’ fictional examinations of surveillance capitalism. While Zuboff’s and Eggers’ works have different points of departure and modes of representation, a comparative reading suggests key points of overlap and disagreement about the impact of surveillance in the contemporary world, about what the future might hold, and about how we should respond. In assessing the relevance of Velmans' work for transpersonal psychology, two major features of his reflexive monism are explored. The first is the notion that consciousness is embedded in the external world and in the body, the second is the principle of reflexivity itself. The embeddedness of consciousness in the world underpins transpersonal notions of consciousness as a primary reality of the universe. Consciousness as embodied is a critical component for therapies and psychospiritual practices that focus on somatic awareness, both (...) central to transpersonal psychology's objectives. The reflexivity at the core of Velmans' theory is identified as a principle that recurs at different scales (the brain, cognition, and the universe), thus relating to esoteric ideas of correspondence across microcosmic and macrocosmic levels of being. For transpersonal psychology, this recognition that 'ancient' esoteric ideas can be substantiated and updated through contemporary research into consciousness opens further avenues of enquiry. Globalization leads to cross-border business transactions between societies with very different norms and regulations regarding bribery. Bribery in international business transactions can be seen as a function of not only the demand for such bribes in different countries, but the supply, or willingness to provide bribes by multinational firms and their representatives. This study addresses the propensity of firms from 30 different countries to engage in international bribery. The study incorporates both domestic (economic development, culture, and domestic corruption in the (...) supplying country) and international factors (those countries’ patterns of trade and involvement in international accords) in explaining the willingness to bribe abroad. The propensity to provide bribes was the lowest when corruption was not tolerated in the multinational firms’ home countries, when the firms’ countries were signatories of the Organization for Economic Cooperation and Development (OECD) anti-bribery convention, and when those countries traded heavily with wealthier nations. Further, these findings are maintained when controlling for levels of economic development and cultural values in the supplying country. In terms of culture, firms from high power distance countries showed a somewhat greater propensity for providing bribes in transactions with less-developed nations. (shrink)

Soft X‐ray tomography (SXT) is an imaging technique capable of characterizing and quantifying the structural phenotype of cells. In particular, SXT is used to visualize the internal architecture of fully hydrated, intact eukaryotic and prokaryotic cells at high spatial resolution (50 nm or better). Image contrast in SXT is derived from the biochemical composition of the cell, and obtained without the need to use potentially damaging contrast‐enhancing agents, such as heavy metals. The cells are simply cryopreserved prior to imaging, and (...) are therefore imaged in a near‐native state. As a complement to structural imaging by SXT, the same specimen can now be imaged by correlated cryo‐light microscopy. By combining data from these two modalities specific molecules can be localized directly within the framework of a high‐resolution, three‐dimensional reconstruction of the cell. This combination of data types allows sophisticated analyses to be carried out on the impact of environmental and/or genetic factors on cell phenotypes. (shrink)

Returning genomic research results to family members raises complex questions. Genomic research on life-limiting conditions such as cancer, and research involving storage and reanalysis of data and specimens long into the future, makes these questions pressing. This author group, funded by an NIH grant, published consensus recommendations presenting a framework. This follow-up paper offers concrete guidance and tools for implementation. The group collected and analyzed relevant documents and guidance, including tools from the Clinical Sequencing Exploratory Research Consortium. The authors then (...) negotiated a consensus toolkit of processes and documents. That toolkit offers sample consent and notification documents plus decision flow-charts to address return of results to family of living and deceased participants, in adult and pediatric research. The presence ofarma uirumquein a particular formation cannot fail to put us in mind of theAeneidand its concomitant ideological associations. A consequence of (...) the epic's centrality as a canonical text was the emergence in antiquity ofarma uirumqueas a synecdochic quotation for the work as a whole and, as such, for the figure of the poet himself. This transformation was further actuated by the ancient practice of ascribing titular authority to a poem's incipit, ensuring that arms and the man took on especial resonance. Even within theAeneid, self-referential intratextual play with the Virgilian utterance can be detected. Furthermore, in post-Augustan verse, Fowler argues thatarmaalone is always loaded in a metaliterary fashion, serving as an identifying marker for Virgil's epic or, more broadly, for epic in general. This was so marked a phenomenon that the opening word of the poem was recycled and reworked by Ovid around a decade after the compositional beginnings of theAeneid, in the first book of theAmores, in what formed an announcement of the redeployment of epicarmainto the elegiac world ofmilitia amoris(Am. 1.1–2). This article discusses N. K. Jemisin's Afrofuturist utopian short story entitled “The Ones Who Stay and Fight,” the opening story of her 2018 collection, How Long 'Til Black Future Month? As is suggested by its title, Jemisin's story is a direct reply to Ursula K. Le Guin's “The Ones Who Walk Away from Omelas,” and this article discusses the ways in which Jemisin, one of the most prominent members of a new generation of SF/Fantasy writers, pays homage to, replies to, (...) and reimagines Le Guin's 1973 story in the twenty-first century. In particular, drawing on utopian scholarship, scholars of Afrofuturism, and the work of African American studies scholar-activists, it argues that Jemisin's utopia builds a world that embodies the “revolution of value” as well as the intersectional Black feminist praxis at the foundation of contemporary activist groups such as Black Lives Matter. It also argues for the ways in which Jemisin's text confronts common criticisms of utopia as well as the limits of the utopian imagination. (shrink)

The purpose of this study was to investigate how the subjective impression of English speech would change when pause duration at punctuation marks was varied. Two listening experiments were performed in which written English speech segments were rated on a variety of evaluation items by both native-English speakers and non-native speakers (native-Chinese speakers and native-Japanese speakers). The ratings were then subjected to factor analysis. In the first experiment, the pauses in three segments were made into the same durations, from 0.075 (...) to 4.8 s. Participants rated the segments on 23 evaluation items on a rating scale from 1 to 10. A varimax rotation after PCA (principal component analysis) led to two factors that were related to speech style. These two factors could be interpreted as representing speech naturalness and speech rate. Speech segments with a pause duration of 0.6 s received the highest naturalness evaluation, while perceived speech rate decreased as the physical pause duration increased, without any changes in utterance segments. In the second experiment, a full-factorial design of pause durations (0.15, 0.3, 0.6, 1.2, and 2.4 s) within and between sentences, i.e., for commas and for periods, was implemented in two speech segments. The original speech segments and speech segments without any pauses were also included as control conditions. From ratings on 12 evaluation items, similar to Experiment 1, two factors representing speech naturalness and speech rate were obtained. The results showed again that the perceived speech rate decreased with an increase only in pause duration. As for speech naturalness, the highest evaluations occurred when pause durations were 0.6 s within sentences, and either 0.6 or 1.2 s between sentences. This recommends fixing all pause durations to 0.6 s as a practical way to train non-native speakers to make their spoken English appear more natural. (shrink)

_Abstract_: The sciences achieved consensus amongst their practitioners through emancipation from philosophy. In the first half of the 20 th century, philosophers began to align themselves with science, and most contemporary philosophers call themselves naturalists. Epistemology was still largely considered a philosophical prerogative until Quine’s paper “_Epistemology naturalized_” (1969). Opinion is now divided. Ironically, the prodigious work that secured Jean Piaget’s reputation as a cognitive developmental psychologist was actually carried out largely in service of epistemology. Disillusioned with philosophical speculation and (...) with a background in empirical science (Piaget trained as a biologist), Piaget conceived a method based on psychological and historical evidence to investigate epistemological questions scientifically. In this paper, I outline his genetic-epistemological method and locate it in the discourse on naturalism. I conclude by classifying genetic epistemology according to Goldman’s classification of naturalistic epistemologies and by assessing it in the light of criticism typically levelled at naturalistic epistemologies, before highlighting some salient points for a future scientific epistemology. _Keywords_: Epistemology; Naturalism; Psychologism; Genetic Epistemology; Jean Piaget _Ritorno al futuro dell’epistemologia scientifica? Deluso dalla speculazione filosofica e formatosi nell’ambito delle scienze empiriche Piaget (che era un biologo di formazione) ha elaborato un metodo basato sull’evidenza storica e psicologica per dare risposte scientifiche a problemi epistemologici. In questo lavoro intendo illustrare il suo metodo epistemologico-genetico, collocandolo all’interno del discorso sul naturalismo. Over the history of the study of visual perception there has been great success at discovering countless visual illusions. There has been less success in organizing the overwhelming variety of illusions into empirical generalizations (much less explaining them all via a unifying theory). Here, this article shows that it is possible to systematically organize more than 50 kinds of illusion into a 7 × 4 matrix of 28 classes. In particular, this article demonstrates that (1) smaller sizes, (2) slower speeds, (...) (3) greater luminance contrast, (4) farther distance, (5) lower eccentricity, (6) greater proximity to the vanishing point, and (7) greater proximity to the focus of expansion all tend to have similar perceptual effects, namely, to (A) increase perceived size, (B) increase perceived speed, (C) decrease perceived luminance contrast, and (D) decrease perceived distance. The detection of these empirical regularities was motivated by a hypothesis, called “perceiving the present,” that the visual system possesses mechanisms for compensating neural delay during forward motion. This article shows how this hypothesis predicts the empirical regularity. (shrink)

Daniel Lagache has said that the psychoanalytical experience is a moral one. It is, in Mme. Amado's words, "the drama of a subject, discovering his radical truth." The task of psychoanalysis is the demystification of the narcissistic, alienated subject who lives in a primary or primitive moment of subjectivity. The moment of cure is the recognition of the other, and simultaneously, a discovery of oneself--intersubjectivity. Mme. Amado gives an excellent phenomenology of alienation, seeing its presence both in mental disorders and (...) normal behavior.--A. B. D. (shrink)

This useful anthology comprises seventy-nine selections arranged under three headings. Part I is titled "Ancient and Classical Ideas of Space"; part II, "The Classical and Ancient Concepts of Time"; part III, "Modern Views of Space and Time and their Anticipations." According to the general editors of the Boston series, R. S. Cohen and Marx W. Wartofsky, Capek’s choice of contents was governed by the desire to show that "parts of our view of nature greatly and mutually influence other parts, and (...) that our conception of the world keeps evolving. Thus, ideas of time intertwine with ideas of space, and both with ideas of matter and force." F. M. Cornford’s essays, "The Invention of Space" and "The Elimination of Time by Parmenides," introduce parts I and II respectively. In part I, while Descartes, Pascal, Gassendi, Newton, etc., speak for themselves, the ancients and medievals are given other mouthpieces—Duhem’s monumental Le système du monde, for Plato, Aristotle, and the medievals; C. Bailey, for Leucippus, Epicurus and Lucretius; Koyré, Höffding, Jammer, for the period from Bradwardine to William Gilbert. On the subject of time, however, both ancient and classical authors are allowed to express their opinions in their own words, with the understandable exception of the Stoics. Part III begins with the prerelativistic critique of Newton as well as the well-known Clarke-Leibniz discussion on the nature of space and time. This third part, however, is dominated largely by the implications of Einstein’s general and special relativity theories. For instance, we have Minkowski’s "Union of Space and Time." Four items, at least, are devoted to the twin-paradox. Some argue for a static, subjective, or even idealistic conception of space-time whereas positivists like Frank attack Sir James Jeans’ and other idealistic interpretations of relativity as instances of meaningless metaphysics. Part III concludes with Weyl’s objectivistic interpretation of quantum-mechanical indeterminacy. While it is difficult to find an anthology that will please all readers or teachers, this work goes far towards dealing comprehensively with the subject of space and time. As Cohen and Wartofsky note, what is distinctive of Capek’s approach within the field of philosophy of nature and its history is that "he is greatly appreciative of Bergson, James, Peirce and Whitehead" and though influenced by them, he is also critical because of the "understanding of the philosophical import that contemporary physics brings into our picture of the world." In a lengthy introduction, the editor explains his rationale for each item he includes. In general this is very helpful, but in some instances the suggested historical connections are misleading at best, if not simply false or questionable. Einstein for instance is said to have "rejected any absolute frame of reference which would be a substrate of absolutely simultaneous events... within the context of Michelson’s vain search for the absolute motion of the earth." This seems to imply—as many others have claimed—that the negative results of the ether-drift experiment influenced Einstein in formulating his relativity theory, whereas historians have pointed out that if Einstein referred to the experiment, it would have to be as a confirmation of his theory, since he did not learn of the results obtained by Michelson and Morley until after the publication of his revolutionary paper in 1905. Though there are other generalizations in the introduction which might be open to dispute, Capek’s prefatory remarks are in general helpful, and the essay collection as a whole stands on its own feet. It is valuable, if for no other reason, that a number of the selections appear in English translation for the first time.—A.B.W. (shrink)

brook muller begins his contribution to the Coss Dialogues by contesting and at least partially deconstructing Le Corbusier’s aphorism “a house is a machine for living.” He then trades upon an ambiguity that masks the difference between watersheds that mark an important transition from one phase to another and those that are defined by the drainage area associated with a body of water. Dass solche Reihen dem Gange der Evolution wirklich entsprechen, ist nach der Erfahrung der Genetiker unwahrscheinlich. Vor zwanzig Jahren hat schonMorgan darauf hingewiesen, dass man die verschiedenen erblichen Typen vonDrosophila der Flügelform und auch der Augenfarbe nach in allmählich abgestuften Reihen ordnen könne, dass aber nichts dafür spräche, dass solche Reihen phylogenetische Bedeutung haben. Für die Haarfarbe vonMus (...) musculus undMus wagneri kommt Verfasser zum gleichen Schluss. Wenn man schwarz und weiss als Extreme einer Farbenserie annimmt, so kann genetisch der Übergang von schwarz zu weiss in einem Sprung gemacht werden oder aber mittels einer Serie von neun Abstufungen, die teilweise rückläufig sind. Wenn man die Wildfarbe, schwarz-agouti, als Ausgangspunkt annimmt, so wird Melanismus mit einem einzigen Sprung, Albinismus aber entweder mit einem Sprung oder mittels einer Reihe von Zwischenfarben erreicht. Für solche Reihen von Zwischenfarben gibt es dann noch verschiedene Möglichkeiten. The target article covers a large amount of ground and offers a provocative perspective. This commentary focuses on (a) assumptions, namely that there are discrete stages in the creative process and that novelty and usefulness are inextricable, (b) hidden variables in the creativity–curiosity relationship, and (c) the difference between an explanation of creativity versus a description of influence on it.

Basically, the author places Heidegger's Sein and Seiende in a theological context; l'être is God, both present in the relations between les étants and absent as the Being of all beings. The task of ontology as a "topique de l'être" is to start with the "phenomenal situation" and dialectically make explicit the meaning of l'être in related "places", i.e., temporal consciousness, world, self, other, and love. The book suffers from scanty exposition and unacknowledged debts to Heidegger and to Merleau-Ponty--A. B.

"This book presents a theory of the nature of things," and counsel in respect of the practical objectives of men. The former marks no advance over the Milesian Pre-Socratics; the latter lacks even the merit of being grounded in a "hard-headed" materialism. --J. A. B.

Merleau-Ponty had projected a work of considerable dimensions, according to Lefort, which was to have borne the title now given to this posthumous volume. Though the chapters he had actually written out and the notes de travail selected by Lefort for this edition seem to be only introductory parts and suggestions of the larger work, they are already considerable in richness, depth and difficulty. Here we find Merleau-Ponty returning to the problems of his earlier works, showing why the problems posed (...) in the Phenomenology of Perception were "insoluble"; examining in ever greater depth the thought of Descartes, Leibniz, Kant, Hegel, Husserl, Heidegger and Sartre; uncovering the naiveté of scientific thinking and the false sophistication of reflective, dialectical and intuitionistic philosophies. He has moved well beyond phenomenology in the strict sense, toward his own interrogation ontologique and a theory of logic. Lefort has done an extraordinary and exemplary job of organizing, editing and annotating the manuscripts. —A. B. D. and C. D. (shrink)

In this paper, we consider three arguments for the irrelevance of the doctrine of double effect in end-of-life decision making. The third argument is our own and, to that extent, we seek to defend it. The first argument is that end-of-life decisions do not in fact shorten lives and that therefore there is no need for the doctrine in justification of these decisions. We reject this argument; some end-of-life decisions clearly shorten lives. The second is that the doctrine of double (...) effect is not recognized in UK law ; therefore, clinicians cannot use it as the basis for justification of their decisions. Against this we suggest that while the doctrine might have dubious legal grounds, it could be of relevance in some ways, e.g. in marking the boundary between acceptable and unacceptable practice in relation to the clinician's duty to relieve pain and suffering. The third is that the doctrine is irrelevant because it requires there to be a bad effect that needs justification. This is not the case in end-of-life care for patients diagnosed as dying. Here, bringing about a satisfactory dying process for a patient is a good effect, not a bad one. What matters is that patients die without pain and suffering. This marks a crucial departure from the double-effect doctrine; if the patient's death is not a bad effect then the doctrine is clearly irrelevant. A diagnosis of dying allows clinicians to focus on good dying and not to worry about whether their intervention affects the time of death. For a patient diagnosed as dying, time of death is rarely important. In our conclusion we suggest that acceptance of our argument might be problematic for opponents of physician-assisted death. We suggest one way in which these opponents might argue for a distinction between such practice and palliative care; this relies on the double-effect doctrine's distinction between foresight and intention.
